Terms of Use

To use our service at Rainbow Forest Centre London Limited (RFCL) to receive consultation and therapy sessions, or as a visitor and user of our website (www.rainbowforest.co.uk) and any other pages or profiles operated by RFCL, you will be deemed to have accepted our Privacy and Cookies Policy and Terms of Use in full.

*Those who receive our Course services, “Terms of Service for Course Clients” will also apply. It will be provided by documents for relevant clients.

 

Our service

 

RFCL provides consultation and therapy sessions for those who have mental health needs or neurodevelopmental conditions. The service is for anybody aged 18 and over who would like to receive our service, or any child aged 18 and under whose primary care giver consent to receive our service for the child, as long as the client/primary care giver is able to understand and acknowledge what is involved in our service and is willing to co-operate and follow the terms of use.

 

We may decline use of our service or suggest alternative support if we feel that we cannot support you, either due to the nature of your problem, our client lists being full - lack of a consultant to suit your specific need, or if you are suicidal, self-harming or suffering mental health crisis. Where possible we may suggest alternative support or that you contact the emergency services.

All material is free for clients and site visitors. Articles are available to provide information only. We are not responsible for any material that is authored by anyone else other than RFCL.  

 

Hours of service

 

Booking requests and enquiries can be sent through contact form at any time. All consultation and therapy sessions, admin and enquiry support is available on Monday to Saturday, at 9:00am to 17:00pm(UK time).

 

Bookings and Payment

All sessions at RFCL need for the time and date to be pre-arranged. RFCL operates on a first book first serve basis. Session slots are provided subject to availability.

After we agree with the provisional booking, the invoice will be issued. A provisional booking will be held within the due date. The appointment will be confirmed when you complete the full payment. We may cancel your appointment if we cannot confirm your payment before the due date and time (See “cancelation policy”).

 

Sessions

The session is 50 minutes either by online or in-person at our Centre or at your home.   

 

Conduct

We will not accept threatening or abusive behaviour towards them. Such behaviour may result in the session ending and the client being liable for the full session cost. Future sessions may not be permitted.

Clients and site visitors are not permitted to attempt to damage the website in any way through the introduction of viruses or any form of malicious or technology. Details of any breach of this will be forwarded to the relevant authorities.

 

Cancellation Policy

If for any reason you need to cancel/reschedule an appointment you will need to provide us with at least 24 hours' notice. We can reschedule the session within 30 days. Any cancellations with less than 24 hours' notice are chargeable for the full session fee.

 

If the session is disconnected due to poor network connections of our site within initial 10 minutes, we cannot refund, but we will reschedule the session for free. If the disconnection is due to client’s network problems, we cannot refund. We will charge another full session fee when you reschedule the session.

 

Disclaimer and Liability

This website contains information and links to other sites which are external to RFCL. It is the user's responsibility to acknowledge the necessary appropriateness of the information contained in other external sites. We are not responsible for the quality of services, products, privacy practices or terms of use of other sites.

 

RFCL does not make any warranties or representations as to the accuracy or completeness of the materials i.e. articles or website content. We may periodically make changes, improvements and/or updates to the materials, articles, and site content without notice. Under no circumstances shall we be liable for any loss, damage, liability or expense incurred or suffered which is claimed to have resulted from use of the website, use of products, materials, website content or any of our services, including without limitation, any fault, error, omission, interruption or delay with respect thereto.

 

RFCL holds no responsibility for a user's telephone, a user's computer system, tablet, software data or technical difficulty occurring in connection with this website or any services and sessions. Rainbow Forest Centre London holds no responsibility and holds no liability in regard to any computer viruses or corruption to any individual client's computer or device.

 

You agree to defend and indemnify RFCL, to hold us and our affiliates harmless as well as indemnifying our respective directors, contractors and employees against any losses, liabilities, claims, expenses (including legal fees) in any way arising from or related to your use of our website or services.

 

Agreement

 

You agree that you are at least 18 years old or you are a primary care giver of the child aged 18 years and under who will receive our service.

 

You agree that you (or your child) are not experiencing a suicidal crisis and are not at risk of harming yourself or anyone else.

 

You agree and understand that therapy sessions can be challenging, as uncomfortable emotions and thoughts can arise as part of the treatment process.

 

You understand that RFCL cannot guarantee a positive outcome, even though we are hopeful that our work together will be of help to you.

 

You agree and understand that once purchased, all session fees are non-refundable, including when you have missed, been late for or have expired sessions.

 

You agree that you are seeking our services for personal session and that you are not using any of our services or material to undertake research for either private use, use for study/projects/assignments of any kind private or public, or in an educational or training capacity, or for publication, or to plagiarise any of our material.

 

You agree that your participation in our services may only be shared for your personal benefit. You agree that your participation will not be shared for any other reason or in any form, be it recordings, transcripts, copying or reporting of or on the experience, your impressions thereof, surveillance and any other use of the session, verbal or otherwise, without your consent. You agree to not record or tape sessions.

 

You understand that as a new, former or current client you are bound by the terms of use. It is your responsibility to keep up to date with the current terms and privacy policy which can be amended at any time without notification.

 

You have read the Privacy and Cookies Policy and agree to our privacy policy and use of cookies.

 

You understand that all discount offers can be withdrawn or modified at any time.

 

You agree that if you are disconnected during an online session that you will email your Consultant as soon as possible and also check your inbox for correspondence from them.

 

You agree that if you do not hear from your Consultant at the agreed online session time you will email them within 5 minutes of the agreed session time.

 

You understand that we do not hold any liability for technological glitches that can take place with chat, voice calling and video calling sessions neither reception issues with mobile phone. You understand that we do not hold any liability for emails that we've sent and due to the recipient's technological errors or device issues are unable to be received. You understand that we are not responsible for issues with Yahoo, Hotmail, Gmail, Live and other email account delays, errors or downtime which cause problems with you sending/receiving emails. However, any glitch or mishap on our part will not be at the client’s loss - clients will receive all of the session time which they have paid for.‎

 

RFCL reserves the right to resist legal requests to produce records in court. We do this in order to protect our duty of confidentiality to all clients and to preserve RFCL’s reputation as a provider of confidential consultation and therapy sessions.

 

With regards to clients who receive our service in the UK, we are unable to provide records or information for legal proceedings when asked by clients, their solicitors, the police and the courts unless a Subpoena ordered by a UK court is ordered. The basic information that is held temporarily, is not suitable as evidence in legal proceedings.

 

With regards to clients who receive our service in Japan, we are able to provide records or information for legal proceedings asked by clients, their solicitors, the police and the courts only with consent of clients. Disclosing client record fees (£50) are applied.

 

You permanently agree to release and indemnify RFCL from all suits, lawsuits, claims and actions originating from our services provided through RFCL.

We take care to maintain client confidentiality in accordance with Counselling and Psychotherapy guidelines along with General Data Protection Regulation (GDPR). Security

 

You will see a padlock in the browser address bar for this website, this lets you know that this is a secure site. We use SSL (Secure Sockets Layer)  this is the standard security technology for establishing an encrypted link between a web server and a browser. This link ensures that all data passed between the web server and your browsers remain private and integral.

 

 

 

RFCL uses a secure system for our consultation and therapy sessions, protecting the information that is collected. All email and contact forms are encrypted. All text chats, voice calls and video calls are confidential. Furthermore:

 

All email accounts are fully encrypted. If you send an email to our email address, only we will have access to it.

 

Voice and video calling sessions are never recorded. Text chats on LINE are deleted within a year after the session. Movies or photos on LINE are deleted within 2 weeks, so are files within a week. Texts on Zoom are deleted within 1 months. Any text chat on LINE and Zoom can be deleted as soon as the session ends on your request.

 

All phones, tablets, laptops, or storage devices required to conduct or aid our sessions have anti-virus and/or double password protected locks.

 

The summary report of your each session and your personal data are saved on a secured cloud software of patient record. Only our PCs encrypted by digital certificate can access this software. These PCs are usually placed in offices both in the UK and in Japan which are secure with 24/7 security service.

 

Confidentiality

 

When possible, RFCL will advise clients of confidentiality and the importance it has on the individual sessions. Any discussions during our sessions will be strictly confidential.

 

Your sessions, however, may be shared with other staff in Rainbow Forest Group (Rainbow Forest Clinic, Rainbow Forest Daycare Centre) on the purpose of training for Consultants. Also, each Consultant may seek for discussion at the company’s regular conference with other Consultants to improve their sessions. Personal information shared through trainings and conferences are also strictly confidential to external parties.  

 

With the signed document with the consent of the client, we will register your data into our anonymous database for future research conducted at all sites in Rainbow Forest Group. If the client is 18 years and under, we need the assent of the client and the consent of their primary care givers. We may use the database for research purpose. The client is not forced to agree with this.

 

 

If your sessions are paid for or arranged via a third party, e.g. a friend, partner, spouse or family member, other than payment requests, invoices or receipts your information will not be shared. Details about what is discussed in your sessions are not disclosed to a third party who arranged the session without the consent of the client (person receiving our service).

 

 

Your sessions may be paid for or arranged by a third party, such as a friend, partner, family member, employer, company, charity or organisation. Your consent is required. The only information that will be shared with your approved third party is payment requests, invoices, receipts and confirmation that your sessions are taking place with RFCL. Details about what is discussed in your sessions are not disclosed to the third party without the consent of the client (person receiving our service).

 

 

All work is to the highest ethical standards. RFCL will only disclose information if necessary, for e.g. if the person either Consultant or client is at risk of harm we are then required by ethics to seek advice and guidance from other professionals. We would, of course, try to discuss this beforehand with you to obtain your assent.  We may also disclose information if there is a suspected case of child abuse or alleged child abuse, known or suspected case of adult or elder abuse.  If Consultant receives information, regarding a proposed or actual act of terrorism, he/she is required to share this with the police. Upon receipt of a subpoena, from a judge in a UK court of law, your Consultant will be bound by British Law to release any information.

 

Information - collection, accessing and deleting

 

Anonymity

 

RFCL will only ask for information that is considered necessary for the effectiveness of our service.

 

Collection of information

 

We do not require personal data such as race, sexual orientation, political opinion or religion.

Name and date of birth will be required for a personal record.

 

Your email address, that you initiate contact form, will be required as a form of contact in order to make appointments. However, we do not require identification such as a passport or a licence etc. Before the sessions begin, the client messenger ID, telephone number, or contacts etc. as well as brief details of what you feel you wish to talk about may be submitted. This information is accessed by our team only. The RFCL will always ensure basic information is gathered accurately.

 

The assigned Consultant may choose to keep offline information about their client's session time/date to stay organised. The information held by the Consultant is stored at least for 5 years.

 

Disclosure of information

 

Your telephone number, messenger ID or email address will not be shared with any outside agencies or third parties.

 

Financial information

 

We do not request proof of income or financial status are available to all. We do not request banking and financial information, no card payments are taken via the phone or on the website. Purchases for our sessions are made securely via the online payment gateway. You can check your purchase history with them directly, they generally send email receipts after each purchase.

 

Access to information

 

You are welcome to request any information we hold about you. To request any information, please contact us, we ask that you allow 30 days for the request to be fulfilled. Please note that we hold basic details for up to 5 years after your last purchase.

 

Deleting your information

 

Within 5 years of last your session, all details will be destroyed. (There may be some rare instances where it is kept in secure offline storage for up to 7 years). If you would like those details to be removed before 5 years please contact us to make that request, we ask that you allow 14 days for that request to be fulfilled.
